How to Appeal a Parking Citation :
The Reading Parking Authority has set up an administrative appeal process for individuals who believe their parking citation was issued in error.
There are two (2) steps of Administrative appeal/review. Each step in the appeal/review process must be taken in order and initiated within strict timeframes. No step can be skipped in favor of jumping to another step.
Administrative Appeal process
First Step – Administrative review
The Parking Violation Appeal form (Complaint and Investigation form) should be completed in person or online within 10 days of the date of issuance of the parking ticket to make the lower penalty applicable. Note: Appeals will not be accepted if made after 30 days of the day of issuance of the parking ticket.The appeal request is only valid for the citation listed. All remaining citations will not be addressed under this appeal.
Individuals will be contacted after the citation has been processed and advised whether the citation will be upheld or dismissed.
If the citation is upheld or appeal is denied and you are unsatisfied, go to step 2.
Second Step – Administrative Hearing
The Reading Parking Authority will schedule a hearing before an independent hearings officer. At this time you will be given the time and date of the hearing.
In order to schedule the hearing, you will be required to post a collateral payment in the amount of your citation (ticket) AND a $5 administrative fee. If the Independent hearing officer dismisses the citation your collateral payment and administrative fee will be refunded.
If the appeal is denied, Individuals will receive in writing his/her right to appeal the denial of his/her appeal to the Berks County Court of Common Pleas,633 Court Street, Reading , PA, within 30 days of the independent hearing officer’s determination.
The following are not reasons for an appeal:
– Lack of knowledge of the City’s parking regulations.
– Appointment conflicts or tardiness going or returning from appointments.
– Inability to find a legal parking space.
– Failure to have appropriate or sufficient amount of coins.
– Broken or malfunctioning parking meter.
